Nomiq is not a law firm and does not provide legal advice. The Platform connects you with independent legal professionals. Nothing on this Platform constitutes legal advice or creates an attorney-client relationship with Nomiq.
By accessing or using the Nomiq platform ("Platform"), available at www.nomiq.in and through our mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.
These Terms constitute a legally binding agreement between you and Nomiq Technologies Pvt. Ltd. ("Nomiq", "we", "us", or "our"), a company incorporated under the Companies Act, 2013 with its registered office in Mumbai, Maharashtra, India.
We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes by email or in-app notification.
Nomiq is an online marketplace that connects individuals and businesses ("Clients") with verified legal professionals ("Lawyers"). Nomiq is not a law firm and does not provide legal advice, legal services, or any form of attorney-client representation.
Any legal advice, representation, or services provided through the Platform are provided directly by the individual Lawyers, who are independent professionals. Nomiq is not responsible for the quality, accuracy, or completeness of any legal advice or services provided by Lawyers on the Platform.
No attorney-client relationship is formed between you and Nomiq at any time. An attorney-client relationship may be formed directly between you and a Lawyer you engage through the Platform, subject to the terms agreed between you and that Lawyer.
To use the Platform, you must:
(a) Be at least 18 years of age; (b) Be legally capable of entering into binding contracts under the Indian Contract Act, 1872; (c) Provide accurate, truthful, and complete registration information; (d) Not be barred from using the Platform under applicable law.
Lawyers must additionally hold a valid enrolment certificate from the Bar Council of India or a State Bar Council, and must maintain such enrolment in good standing throughout their use of the Platform. Lawyers are responsible for ensuring their profile accurately reflects their qualifications, specialisations, and experience at all times.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@nomiq.in of any unauthorised use of your account.
You may not share your account credentials with any third party. Each person must maintain their own account. Nomiq reserves the right to suspend or terminate accounts that violate these Terms.
You agree to provide accurate information and to update it promptly if it changes. Nomiq may verify the identity and credentials of any user at any time and may suspend accounts where verification fails.
As a Client, you agree to:
(a) Provide accurate and complete information when posting a legal request; (b) Use the Platform only for lawful purposes and in accordance with these Terms; (c) Not post requests that are fraudulent, misleading, or intended to cause harm; (d) Pay any agreed consultation or service fees to Lawyers promptly; (e) Treat Lawyers with respect and professionalism; (f) Not attempt to contact Lawyers through channels outside the Platform in a manner that circumvents Nomiq's fee structure without Nomiq's prior written consent.
As a Lawyer, you agree to:
(a) Maintain an active and valid enrolment with the Bar Council of India or relevant State Bar Council; (b) Provide accurate information on your profile, including qualifications, experience, and practice areas; (c) Comply with the Bar Council of India Rules on Standards of Professional Conduct and Etiquette; (d) Maintain professional indemnity insurance as required by your professional obligations; (e) Respond to client enquiries in a timely and professional manner; (f) Not charge fees in excess of those agreed with clients prior to engagement; (g) Maintain client confidentiality in accordance with professional rules and applicable law.
Nomiq charges platform fees as set out in our Pricing page. These fees are subject to change with 30 days' notice to registered users.
All payments made through the Platform are processed by our authorised payment partners. Nomiq does not store full payment card details. Payments are governed by the terms of our payment partners.
Consultation fees are agreed between Clients and Lawyers independently. Nomiq facilitates payment collection and disburses amounts to Lawyers after deducting applicable platform fees, within 3 business days of a completed consultation.
GST is applicable on Nomiq's platform fees as required by the Goods and Services Tax Act, 2017.
All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof ("Content"), is the property of Nomiq or its content suppliers and is protected by the Copyright Act, 1957 and other applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Content without Nomiq's prior written consent. User-generated content (such as reviews and legal requests) remains owned by the respective users, but you grant Nomiq a non-exclusive, royalty-free, worldwide licence to use, display, and publish such content in connection with operating the Platform.
To the maximum extent permitted by applicable law, Nomiq shall not be liable for:
(a) Any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform; (b) The quality, accuracy, or outcomes of any legal services provided by Lawyers through the Platform; (c) Any loss of data, profits, or business opportunities; (d) Any unauthorised access to or use of our servers and/or any personal information stored therein.
Nomiq's total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount paid by you to Nomiq in the 12 months preceding the claim, or ₹10,000 (whichever is lower).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.
Before initiating legal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days. If unresolved, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with Mumbai as the seat of arbitration.
If you have a complaint about the Platform or our services, please contact us first at legal@nomiq.in. We will endeavour to resolve all complaints within 14 business days.
You may terminate your account at any time by contacting us at support@nomiq.in or through the account settings page. Upon termination, your right to use the Platform ceases immediately.
Nomiq may suspend or terminate your account at any time if you breach these Terms, engage in conduct that harms the Platform or other users, or for any other reason at our sole discretion. We will provide notice of termination where reasonably practicable.
Upon termination, clauses 8 (Intellectual Property), 9 (Limitation of Liability), and 10 (Governing Law) shall survive.
