May 25, 20266 min readBy Nomiq Legal Team

Your Rights Under the Consumer Protection Act 2019

The Consumer Protection Act 2019 replaced the 1986 Act and is significantly stronger. You are a "consumer" if you buy goods or services for personal use — this includes online purchases, services, education, healthcare, and more.

Where to File

District Consumer Commission — claims up to ₹50 lakh

State Consumer Commission — claims ₹50 lakh to ₹2 crore

National Consumer Commission (NCDRC) — claims above ₹2 crore

Step-by-Step: Filing Online

1. Go to consumerhelpline.gov.in or the e-Daakhil portal (edaakhil.nic.in)

2. Register with your Aadhaar/mobile number

3. Fill the complaint form — describe the deficiency in service or defect in goods

4. Attach evidence: bills, receipts, emails, screenshots, medical reports

5. Pay the filing fee (₹100–₹1,000 depending on claim amount)

6. Submit — you'll get a case number

What You Can Claim

  • Refund of amount paid
  • Replacement of defective goods
  • Compensation for mental agony and harassment
  • Legal costs

  • Tips for a Strong Complaint

  • Document everything — keep all receipts, chats, emails
  • Send a legal notice first — many companies resolve before a formal complaint
  • File within 2 years of the cause of action
  • Be specific — mention exact amounts, dates, and what remedy you want

  • Common Winning Cases

E-commerce delivery fraud, hospital negligence, builder delays, insurance claim rejections, and educational institution fee refusals are among the most commonly won consumer cases in India.
